Policies and Terms

Reservation Policy

In order to place a reservation in any class offered at Cycle Fusion, LLC, customers must first purchase a “Class or Package”. Cycle Fusion, LLC, accepts Visa and MasterCard, via our App or at the Studio. Your credit or debit card will be charged in the amount of your order when you submit your reservation.

Class Cancellation Policy

To prevent being charged for a missed class, a 24 hour cancellation notice prior to reserved class time is required. Classes cancelled within the 24 hour window will be added back to your Package and you will not be charged for that class. Customers may cancel a reservation on Cycle Fusion’s App or website. Classes not cancelled prior to the 24 hour window, will be charged to the customer and their spot will be available to another customer. For monthly memberships, a penalty fee of $15.00 per reservation will apply. Customers with standard packages who cancel after the 24 hour cancellation window will be deducted a single class ride.

Wait List Policy

Open bikes or classes will be given away to standbys the moment class starts. Please understand that if you are late and have a reservation, you may lose your spot. If the class you wish to attend is sold out, please put yourself on the waitlist through Cycle Fusion’s App. If there are cancellations prior to the late cancellation window of 24 hours, you will automatically be added to the class and notified of such. If you do not get in off the waitlist, your class credit will be returned to your account to be used at another time. There are no refunds issued.

Non Paying Customers

Non paying customers or customers who are not scheduled for a class are not permitted to be in studio areas. Children under the age of 18 must have parental consent to participate in any class at Cycle Fusion. Cycle Fusion, LLC, reserves the right to determine if a child under the age of 18 may participate in a class at Cycle Fusion.

Term

Cycle Fusion, LLC, may terminate your Personal Training, Yoga Private Sessions, Unlimited Monthly Package, Enrollment, Class Package or Class at any time, without warning, if you breach either the Terms and Conditions or the Website Terms of Services. If Cycle Fusion, LLC, terminates your Personal Training, Yoga Private Sessions, Unlimited Monthly Package, Enrollment, Class Package, or Class, because you have breached the Terms and Conditions or the Website Terms of Service, you will not be entitled to a refund of any unused portion of your Personal Training, Yoga Private Sessions, Unlimited Monthly Package, Enrollment, Class Package or Class, or other fees.

I agree that if any portion of this agreement is found to be void and unenforceable, the remaining portion will remain in full force and effect. I agree that the Terms and Conditions cannot be modified orally. I have read and understand this document and I agree to be bound by its terms.

I understand and agree that these Terms and Conditions are intended to be a legally binding contract and is to be interpreted under the laws of the State of West Virginia and that if any portion of this document is held to be invalid, the remaining provisions shall continue in full legal force and effect. This document contains the entire agreement between myself and Cycle Fusion, LLC, for the purposes of participating in Programs, Classes, Boot Camp, Cycling, Yoga, Aireal Yoga, Personal Training, or any other group exercise class, or use of related equipment.

Fees and Payments

Packages

Personal Training, Yoga Private Sessions, packages and classes are non-transferable between clients. Customers shall not be relieved of the obligation to make payments agreed to, and no deduction from any payment shall be made because of a customer’s failure to use their package at Cycle Fusion, LLC. Packages have an expiration date depending upon packages purchased. Classes or packages not used within the expiration date will be terminated. Customers will not receive a credit or class for package expiration. There are no pro-rations for class packages or enrollments.

Payment Withdrawal and Security

All payments are payable by electronic funds transfer from the customer’s credit card or debit card on file. Customer must authorize payments to be made through a third party administered electronic funds transfer system (EFT). Customer maintains full control and privacy over the account at all times. The transfer of funds affects only those that have the customer’s prior authorization or when a member authorizes any additional transaction such as a single class, class packages, or retail transactions at Cycle Fusion, LLC. This also includes charges associated with late cancellation and no shows. In the case of monthly unlimited packages, transfer of fees will take place automatically each month for the term of the unlimited monthly package.

Freezing Unlimited Monthly Packages

If customer has an Unlimited Monthly Package, with a 3 month expiration, and is medically unable to use their Unlimited Package, the customer may request a freeze of their 3 month Unlimited Package for up to 3 months. No freeze option is available for non-medical reasons or any other class package option.

Returned Payment Penalty

Customer will automatically be charged any bank fee imposed to the studio, plus a processing fee of up to $40.00 for any returned payment item due to closed account, insufficient funds, or similar issue. On such occasion, Cycle Fusion, LLC, retains the right to collect the current and past due balances in any subsequent month. Disputed Charge Penalty. In the event that a customer initiates a credit card dispute that is subsequently resolved in Cycle Fusion’s favor, Cycle Fusion, LLC has the right to charge the customer up to $50.00 per occurrence.

Return Policy

All, Personal Training, Yoga Private Sessions, Unlimited Monthly Packages, Enrollments, Class Packages, and Single Class sales are final. If you chose not to continue your, Personal Training, Yoga Private Sessions Unlimited Monthly Package, Enrollment, Class Package or Single Class, you are not eligible for a refund.

All merchandise sales in the studio are final. Refunds for merchandise will only be eligible in the form of an exchange or merchandise credit.

CYCLE FUSION, LLC, Terms and Conditions

These Terms and Conditions apply to anyone who purchases any type of Unlimited Monthly Package, Enrollment, Class Package, or Single Class, of Personal Training, Boot Camp, Yoga, Cycling, AIREAL Yoga, or Group Fitness at Cycle Fusion, LLC. Please read these Terms and Conditions carefully. These Terms and Conditions are subject to change at any time, without prior written notice. Any changes will be incorporated into the Terms and Conditions from time to time.

Because physical exercise can be strenuous and subject you to risk of serious injury, Cycle Fusion, LLC, urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity.

Customers assume the risk of any and all accidental injuries of any kind that may be sustained by use of Cycle Fusion’s facility. Customer has been informed and acknowledges that Cycle Fusion, LLC, makes no claim as to medical or fitness results that can or may be obtained through use of Cycle Fusion’s facility, equipment, and services and to protect against accidents by other customers.

Customers are urged not to bring valuables onto or into Cycle Fusion’s premises, and to keep valuables with them at all times. Cycle Fusion, LLC, shall not be liable for the disappearance, loss or theft of, or damages to personal property. Lockers are available in the women’s and men’s locker rooms. Locks are not provided and customer should bring their own lock. Lock needs to be removed after use and are not permitted to remain on lockers when customers are not in the facility.
